Child Custody: Can the Father Win?

Can fathers win primary custody of a child during or immediately after a divorce? The answer is absolutely yes. Courts are charged with deciding what is in the best interest of the child, and the answer is not necessarily that the child would fare better in the custody of the mother. This is equally important for mothers to take notice of when trying to win custody of the child.

Both parents must be aware of the option of joint child custody, which is becoming more common in the court systems of the U.S. Joint custody is often a viable and constructive way of handling the situation. In most cases of joint custody, the parents must agree on the big decisions within the child's life, such as religious and scholastic education, healthcare, etc. 

However, joint custody does not necessarily mean an equal sharing of the child's time. Joint custody can be handled in a number of differing ratios of time with the child.

In the decision of which parent should have custody of the child, questions arise as to the habits and lifestyle of the child. Which parent is more involved in these everyday aspects of the child’s life is a question of great importance. Who makes the child's schedule? Who puts the child to sleep at night, and who gets him or her ready in the morning? Who looks after the child's health? Whichever parent is more involved in activities, be they the mother or father, can benefit greatly.

It is also important to note that within the U.S., each state retains its own laws concerning child custody, and the parents involved must be aware of the laws and procedures under which they must operate.
